2. Services
- JXN Photography ("Photographer") agrees to provide the photography services discussed and agreed upon at booking.
- The Photographer will use professional artistic judgment regarding composition, lighting, posing, camera settings, image selection, editing, and final presentation.
- Reference images or requested poses may be used as inspiration but do not guarantee an identical result.
- The Photographer is not required to deliver every image taken. Test images, duplicates, rejected images, RAW files, and unedited images are not included unless specifically agreed in writing.
3. Session fee & payment
- The total session fee is the total shown at booking.
- The total session fee is the amount written in section 1.
- A 50% retainer is due after booking to reserve the session date and time. The retainer is credited toward the total session fee and is non-refundable if the Client cancels.
- The remaining balance is due no later than the start of the session unless otherwise agreed in writing.
- The session is not confirmed until the required retainer has been received.
- Additional services, extra time, travel, prints, location fees, or other products requested by the Client may result in additional charges.
- Final photographs do not have to be delivered until all amounts due have been paid.
- If there is a problem with a charge, the Client agrees to contact the Photographer first to resolve it before disputing the charge with their bank or card issuer.
4. Late arrival & extra time
- The session begins at the scheduled time. Late arrival may reduce the available shooting time and does not automatically extend the session.
- Additional 30 minutes: $50. Extra time is subject to Photographer availability and must be agreed upon before or during the session.
5. Cancellation & rescheduling
- The Client should notify the Photographer as soon as reasonably possible if they need to cancel or reschedule.
- If the Client cancels, the retainer is forfeited.
- The Photographer may allow one rescheduled session with at least 48 hours' notice, subject to availability.
- A no-show, or a cancellation or reschedule with less than 48 hours' notice, may require a new retainer to book another session.
- If the Photographer must cancel or cannot perform the session, the Photographer will make reasonable efforts to reschedule or refund amounts paid for services not provided.
6. Weather
- For outdoor sessions, if weather makes the shoot unsafe or would seriously affect the photos, the Photographer and Client will decide together whether to move the session.
- If a session is cancelled because of weather, the Client will not lose their retainer. The Photographer will reschedule the session at no extra cost, or, if a new date doesn't work for the Client, refund all amounts paid.
7. Client responsibilities
- The Client is responsible for providing accurate information, arriving on time, following reasonable session instructions, and communicating important needs before the session.
- The Client is responsible for clothing, grooming, and personal belongings unless otherwise included in the package.
- Guests must be approved by the Photographer and must not interfere with the session. The Client is responsible for supervising minors and guests they bring.
- If the Client chooses a location on private property (for example a business, parking lot, or home), the Client confirms they have permission from the owner to photograph there.
8. Prints & travel
- Physical prints are not included unless stated in the selected package.
- Current on-site 4×6 prints: 1 for $5 · 2 for $8 · 5 for $20 · 10 for $35.
- The standard service area includes the Kansas City metropolitan area as defined by the Photographer. Travel outside the standard area may have an additional fee disclosed before the session.
- Permit, parking, admission, or other location fees will be the responsibility of the party agreed upon before the session.
9. Editing & image delivery
- The Photographer controls the final selection and artistic editing style.
- Standard editing may include color, exposure, contrast, cropping, and basic retouching. Extensive retouching or special editing may require an additional fee.
- Final edited photographs will be delivered through an online gallery or another agreed method.
- Estimated delivery time is the turnaround shown for the selected service when booking.
- Delivery time is an estimate unless a specific deadline is agreed in writing. The Client is responsible for downloading and storing delivered files. RAW files and unedited photographs are not included.
- The Photographer keeps backup copies of delivered photographs for 90 days after delivery. After that, re-delivery cannot be guaranteed.
10. Copyright & personal use
- The Photographer retains copyright ownership of the photographs. Payment does not transfer copyright ownership.
- The Client receives a limited license to use final delivered photographs for personal, non-commercial purposes, including personal social media, personal websites, personal printing, personal display, and sharing with friends and family.
- The Client may not sell, license, commercially distribute, or use the photographs for business or paid advertising without written permission from JXN Photography.
11. Promotional use
- Use of photographs containing an identifiable person for portfolio, social media, advertising, competitions, or other promotional purposes is governed by the separate JXN Photography Model & Photo Release.
- This Agreement does not by itself grant or deny promotional permission.
12. Safety & automotive sessions
- For automotive sessions, the Client remains responsible for safely and legally operating their vehicle. The Photographer will not require or encourage unsafe or illegal driving.
- On request, the Photographer will blur or hide vehicle license plates in delivered photos and in any promotional use.
- The Photographer may stop or end a session when reasonably necessary because of unsafe, threatening, abusive, intoxicated, illegal, or seriously disruptive conduct.
13. Liability
- The Photographer will take reasonable care while providing services but is not responsible for circumstances outside reasonable control, including severe weather, illness, traffic, venue restrictions, accidents, or equipment failure.
- If images are lost or damaged because of technical failure or circumstances beyond reasonable control, the Photographer will make reasonable efforts to recover or recreate them when possible. If the service cannot reasonably be completed, the Photographer will reschedule or refund amounts paid for services not provided.
